The Constitutional Court admits Vox's appeal against the 'law of only yes is yes'

MADRID, 24 Ene. (EUROPA PRESS) -

The Plenary of the Constitutional Court (TC) has agreed in its plenary session this Tuesday to admit for processing the appeal presented by Vox deputies against what is known as the 'law of only yes is yes', according to legal sources consulted by Europa Press.

Vox's appeal, whose presentation has fallen to magistrate Ramón Sáez, is directed against the fourth, seventh and seventeenth final provisions of Organic Law 10/2022, of September 6, on the comprehensive guarantee of sexual freedom.

The legal vice president of Vox, Marta Castro, explained when presenting the challenge that they were appealing because they believe that the new law is a "legal aberration" for "violating all the basic principles of the legal system and the Constitution."

Castro indicated that it violates the principles of legality, legal certainty and presumption of innocence, since, in his opinion, the new regulation of consent "inverts the burden of proof."

For those of Santiago Abascal, the law leaves "victims unprotected" and allows a "very broad framework of discretion for analysis by the judge, in each of the cases."
