The general secretary of the Catalan Federation of Restaurants and Musical Activities Associations (Fecasarm) and of the Spain Nightlife employers' association, Joaquim Boadas, has defended this Tuesday the "clear legitimacy" of the two employers to be a popular accusation in the case investigating footballer Dani Alves for alleged sexual assault.

In statements to Europa Press, Boadas said that the Investigating Court 15 has to transfer to the parties in the procedure - the defense, the private prosecution and the Prosecutor's Office - the petition that he presented on Monday to be able to appear as popular prosecution.

The parties have three days to position themselves and, after receiving their arguments, the judge will decide whether or not to admit the associations as an accusation, which could be resolved as of Monday.

Boadas maintains that Fecasarm and Spain Nighlife are entitled to appear in person: "The events occurred in a nightlife space, the sector has invested a lot in preventing these attacks and these behaviors, I think we are the first to be able to appear and demonstrate against ".

In this sense, he has made reference to being able to protect the prestige of the sector and has indicated that "case law has always said that public prosecution, in cases like this, is not excluded from the regulations and is not excluded even if it is not expressly recognized" .

He recalled that the Prosecutor's Office opposed his association being a prosecuting party in the case for the rape of a minor in Igualada (Barcelona) but that the judge admitted them anyway, and he is confident that in the case against Alves the judge will also admit them " because legally it is feasible.

Boadas has assured that, if Alves' authorship is proven, they will advocate "an exemplary sentence that feels a before and after in sexual assaults in nightlife spaces", which could reach 12 years in prison.

"I anticipate that if we are a popular accusation and its authorship is finally proven, we will ask for the maximum penalty" as Fecasarm has done in the 24 cases where he has served as an accusation up to now.
