Judicial associations criticize the profile of the government candidates for the TC: "It deteriorates the image of impartiality"

They regret the choice of profiles with "obvious links to parties": "It is another episode of destruction of trust"

MADRID, 29 Nov. (EUROPA PRESS) -

Three of the four judicial associations have criticized the profile of the candidates chosen by the Government to form part of the Constitutional Court (TC) considering that this designation "deteriorates" the "image of impartiality" of the institution. Judges and Judges for Democracy (JJpD), on the contrary, has claimed the separation of powers and has shown its respect for the Executive's decision.

The Government of Pedro Sánchez has defended this Tuesday the suitability of its two candidates for the TC - the former Minister of Justice Juan Carlos Campo and the former director general of the Ministry of the Presidency Laura Díez - and has relied on a ruling from the court itself of guarantees to appoint its two magistrates without the two that corresponds to designate the General Council of the Judiciary (CGPJ).

In statements to Europa Press, Juan José Carbonero, executive member of the Professional Association of the Magistracy (APM), has assured that the choice of Campo is "barely compatible with the problem related to revolving doors." "The precedent of Dolores Delgado is repeated again. It is a pattern that is repeated in the designating habits of this Government," he pointed out, alluding to the appointment of the also former Minister of Justice as State Attorney General.

Carbonero, who believes that the movement "qualifies by itself," stresses that it "does not contribute to improving the appearance of impartiality" of State institutions. "We think, without prejudice to the personal qualities that may adorn the candidates, that it is not good news," he added.

For his part, the spokesman for the Francisco de Vitoria Judicial Association (AJFV), Jorge Fernández Vaquero, regretted that the Executive's candidates have "obvious ties to political parties." "It is another episode of destruction of public confidence in our institutions. It is an evil that we are suffering and that is spreading to our entire constitutional system. It has a very difficult solution," he lamented.

For her part, the spokesperson for Judges and Judges for Democracy, Ascensión Martín, has claimed the separation of powers while making it clear that she respects the criteria followed by the Government. "They are also two well-known jurists of proven competence," she added.

Finally, the president of the Independent Judicial Forum (FJI), Fernando Portillo, explained to Europa Press that they consider this decision "a lost opportunity to give prestige to the body." "The problem is that we are once again privileged spectators of how revolving doors work in this country, and then we are talking about a specific person, from Campo, where we do not believe that he will contribute to the prestige of the institution," he opined. .

From his point of view, the TC "should go to the most capable". "I'm not saying that he doesn't have the capacity, but it says a lot that they haven't been able to find someone else. His career is nothing more than political: he has held socialist positions since 1991. They are putting the fox to guard the chicken coop," he criticized .

In this sense, Portillo believes that being part of a body that "is going to review the laws approved" by his own party, the PSOE, does nothing but "damage the prestige" of an institution by raising suspicions about its "apparent impartiality."
