Hearing Valladolid lowers the sentence of a man convicted of sexually assaulting a minor under 16 years from 12 to 10 years

The entry into force of the Law for the Comprehensive Guarantee of Sexual Freedom, also called the "Only yes is yes" law, has also had its effects in Valladolid, where the Provincial Court has decided to reduce the sentence from twelve to ten years in prison imposed on a man convicted of sexual assault on a minor under 16.

If to date the Superior Court of Justice of Castilla y León had announced three resolutions affected by the new regulations, one in Segovia and two in León, which apply the most favorable norm to the accused after the aforementioned reform of the Penal Code, The list is now added by a fourth issued by the Second Criminal Section of the Valladolid Court.

This is a sentence, dated January 28, 2021, which has now been reviewed by the Valladolid Court and in which, as in the three previous cases, a man with the initials M.B.B, who was imposed then a sentence of twelve years in prison for sexual assault on a minor under 16 years of age with vaginal access, together with the corresponding prohibitions on communication and approaching the victim and five years of probation.

Thus, in application of the new regulations, the court has analyzed said sentence and has resolved to reduce the sentence to ten years, after hearing the Public Prosecutor's Office and other parties involved in the case.

Against the aforementioned sentence, an appeal can be made before the Civil and Criminal Chamber of the Superior Court of Justice of Castilla y León, based in Burgos.
