The Supreme Court (TS) has ruled this Tuesday on the application of the 'law of only yes is yes' in the framework of the 'Arandina case', establishing that the sentence may be reduced for those convicted of sexual crimes due to the entry into force of the new standard, although it has insisted on the need to analyze it on a case-by-case basis.

As reported by the Supreme Court, the Criminal Chamber has stressed that Law 10/2022 may be applied to the benefit of the prisoner when a lower penalty is now set in those cases in which it is appropriate, but analyzing it on a case-by-case basis, and not globally.
