The Central Military Robe Court number 1 has agreed to initiate preliminary proceedings -a step prior to deciding whether to open an investigation- after receiving a complaint against the Zaragoza judge who in 2003 issued the death certificates of the soldiers who died in the accident of the Yakovlev 42 (Yak-42).

In the order of this court, dated August 9 and to which Europa Press has had access, in addition to opening these proceedings, it is resolved to send an official letter to the Court of Instruction number 9 of Madrid to know the status of the actions that follow on them. facts. In addition, he will forward both the complaint --formulated by a retired artillery commander and operational military investigator-- as well as the report of the military legal prosecutor.

It should be remembered that it was on May 26, 2003 in Trabzon (Turkey) when a plane subcontracted by the Ministry of Defense - directed at the time by Federico Trillo - crashed and in which 62 Spanish soldiers were traveling returning from a mission in Afghanistan . The relatives of the victims denounced that the plane did not meet the necessary security conditions and there were convictions for falsifying the identification of a large number of the deceased.

Now, this military court, after receiving the complaint, and having heard the Public Ministry, opens these proceedings, prior to a possible criminal judicial proceeding, to study the participation of the Military Robed Judge number 32 of Zaragoza in the reception of the victims of the Yak-42.

As stated in the order, the complainant considers that this judge collaborated, outside his demarcation, in a serious crime of falsifying records and issuing false reports for criminal purposes. And he maintains that the facts can be described as "a very serious crime of disloyalty and against the effectiveness of the Armed Forces and others derived from the interference of a military judge in civil matters."

The resolution indicates that the Public Ministry, after receiving the complaint, specified that preliminary proceedings were necessary before ruling on the merits of the complaint given the nature of the facts. With this, it seeks to verify the object and the circumstances of the complaint.
