Unidas Podemos, Esquerra Republicana and Bildu have registered a non-legal proposal to request the regulation of non-psychoactive cannabis or hemp -those whose percentage of tetrahydrocannabinol (THC), the euphoric drug, is less than 1%--, in order to to offer legal certainty to producers and marketers.

Specifically, the minority government party and its two pro-independence allies urge the Executive to "advance in the comprehensive regulation of non-psychoactive cannabis to provide legal certainty to the activities of production, marketing and consumption of products derived from industrial hemp".

As they explain, in recent years, hemp-derived products with very low THC values, commonly known as non-psychoactive cannabis, such as CBD, have begun to be marketed throughout Europe, and they warn that maintaining a restrictive approach and contrary to the regulatory reality of the European Union relegates the Spanish State to a situation of backwardness and legal uncertainty for the people who produce and market this plant and its derivatives.

Its intention is to approve a state standard that regulates all aspects that affect the activities of the non-psychoactive cannabis production cycle, as well as regional legislation on agriculture, developing the European directives for the cultivation of industrial hemp in a more precise way. .

The initiative, collected by Europa Press, claims that this future regulation of non-psychoactive cannabis limits the percentage of THC to 1%, in order to ensure both the absence of narcotic effects and a higher crop yield and its sustainability in accordance with the European Green Pact . Otherwise, they believe that Spain would be operating in this market at a clear disadvantage compared to neighboring countries.

Likewise, they ask the Spanish Agency for Medicines and Health Products (AEMPS) to commit to the European jurisdictional order by making a declaration in accordance with the CJEU resolution of November 19, 2020 regarding the non-monitoring of CBD, since it is not of a stupefying substance.
