The president of the Constitutional Court (TC), Cándido Conde-Pumpido, has commissioned the preparation of a "shock plan" to update the pending amparo appeals within 6 months, including those presented by the former deputy of Unidad Podemos Alberto Rodríguez for the loss of his seat after the sentence imposed on him by the Supreme Court (TS).

As reported by the TC, the processing of the amparo appeals "is currently seriously delayed", for which reason it has ordered the design of this "shock plan" to a work team made up of the general secretary of the TC, Andrés Gutiérrez; the assistant general secretary, Juan Carlos Duque; and the lawyer attached to the president, Ignacio Sánchez Yllera.

In addition, to collaborate in this update, it has been agreed to hire eight new collaborating lawyers, whose call has already been sent to the Official State Gazette (BOE).

The preparation of the "shock plan" was decided at a work meeting held on Wednesday in the president's office, and which was attended by all the coordinating lawyers of the various specialties that work in the TC (civil, criminal, social, contentious- administrative and parliamentary).

Among the amparo appeals that are still in the pipeline, those presented by Rodríguez stand out: one against the sentence handed down by the Supreme Court on October 6, 2021 for kicking a policeman during a demonstration that took place in 2014 in La Laguna (Tenerife ); and another due to the decision adopted on October 22, 2021 by the president of the Congress of Deputies, Meritxel Batet, to withdraw her seat as a result of the execution of that ruling.

The former 'purple' parliamentarian went to the Constitutional Court in February 2022 and shortly after, in May of that same year, the court admitted them for processing without making any decision on the matter since then.

In his letter, to which Europa Press had access, the prosecutor of the TC Pedro Crespo was in favor of granting him the protection for the loss of the seat but not for the sentence of the Supreme Court.

The presentation on the amparo appeal against the withdrawal of the status of deputy corresponds to the magistrate María Luisa Balaguer, while the one related to the sentence of the TS has fallen to María Luisa Segoviano.

Segoviano, who joined the TC on January 9, when the partial renewal of the court was completed, inherited the presentation of one of the four outgoing magistrates, Santiago Martínez-Vares.

It so happens that this magistrate was the vice president of the Central Electoral Board (JEC) which, in compliance with the TS ruling, issued the deputy credential to Fátima González, replacing Rodríguez.

The legal sources consulted by Europa Press indicate that, for this reason, the defense of the former parliamentarian of United We Can is already studying the possible recusal of Segoviano.
