CGPJ calculates that there are 646 reductions in sentences for sexual offenders and 65 releases with the law "only if it is yes"

The General Council of the Judiciary (CGPJ) has estimated 646 reductions for those convicted of sexual crimes and 65 releases due to the new framework of penalties that includes the 'law of only yes is yes', according to legal sources confirmed to Europe Press.

This provisional calculation has been prepared by the CGPJ based on the data provided by the Supreme Court, the regional superior courts of justice and the provincial courts. The Council itself will release detailed data on Tuesday based on information collected by the courts.

Legal sources have indicated that the data provided corresponds to those sentences already reviewed that have experienced a reduction in sentences. Of the pending review, data will be available later as it depends on the Justice Administration Lawyers, who have been on indefinite strike since January 24.

In addition, data will be provided on sentences handed down under the new 'only yes is yes' law for crimes committed under the previous law and whose sentence is favored by retroactivity.

The CGPJ agreed in plenary session to now request from the Superior Courts of Justice (TSJ) and the provincial courts the resolutions issued in relation to the application of what is known as the 'law of only yes is yes'.

Thus, it reported that, at the proposal of the spokesperson and president of the Observatory against Domestic and Gender Violence, Ángeles Carmona, "the presidents of the TSJ and of the provincial courts will be addressed to send to the governing body of the judges all the resolutions issued in relation to Organic Law 10/2022, of September 6, on the comprehensive guarantee of sexual freedom".

"The purpose of the petition is to make a detailed analysis of the incidents that have arisen in the application of the law and to be able to offer verified data in a transparent manner," the CGPJ said in a statement.

According to data from penitentiary institutions, as of December 2022 there were 4,023 prisoners in Spanish prisons for crimes against sexual freedom, including some in pretrial detention, according to prison sources.
