The Supreme Court has sentenced two men to six years and 11 months in prison who in 2014 raped two women with chemical submission in Barcelona. The magistrates have concluded that the defendants, "with the intention of satisfying their sexual desire" with the victims "and without their resisting", invited the two victims "to drink beer with which they had mixed methoxetamine".

According to the sentence, to which Europa Press has had access, the women "consumed ignoring the presence of said drug in the drink." The substance subjected both to "a numbness close to anesthesia", which allowed the defendants to take them to separate rooms, remove their clothes and "touch their entire bodies" and then sexually assault them.

In 12 pages, the magistrates of the Criminal Chamber have explained that the women "couldn't do anything to avoid it" and that the police agents -- who helped the young women once they were in the street -- confirmed that "the girls They were lying on the ground, with symptoms of being drugged and who did not recognize the voluntariness of the experience lived". As they stressed, one of the victims was "paralyzed and like a zombie."

The situation was confirmed by the forensic doctor and the gynecologist. In addition, the genetic analysis of the biological remains collected from the vaginal area of ​​both women shows that they were penetrated by both defendants, which they initially did not admit, according to what was collected in the sentence of which Judge Pablo Llarena was the rapporteur. .

In addition, the Supreme Court has highlighted that even if the women had agreed to ingest the drug, the sexual relations were not consensual because they were maintained when the victims "were deprived of any possibility of consenting to them."

During an entry and search held the day after the events, the police authorities found 13 packages with 4.846 grams of phenacetin and methoxetamine in the refrigerator. The case went to court in 2016.

In 2020, the Provincial Court of Barcelona sentenced two of the defendants to seven years in prison for a crime of sexual abuse with carnal access on victims deprived of meaning. He also imposed a measure of probation for five years and the prohibition to approach the victims, as well as the payment of compensation of 15,000 euros. They were cleared of two injury fouls.

A third defendant, who touched the women, was sentenced to two years and six months in prison for a crime of prejudicial sexual abuse. Dissatisfied with the ruling, they filed an appeal to review the sentence.

The Supreme Court has partially upheld the appeal and has considered it pertinent to apply the mitigating factor of undue delay, for which it has slightly lowered their sentence and sentenced them to six years and 11 months in prison and disqualification for a crime of sexual abuse.

On the argument that the sexual relations were consensual, the High Court has underlined that one of the women assured that she did not remember anything because she fell "deep asleep immediately after drinking that beer". The other victim said that she "began to feel bad but she did not fully lose consciousness of herself, perceiving that they touched her and that they penetrated her, but without her being able to oppose because she was paralyzed and without strength."

The magistrates have stressed that in this discrepancy of versions, the court "not only values ​​that the story of the accused has been adapted to the objective discoveries that derive from the investigation, thereby showing that their version is not real and that it is modulated by a clear exculpatory interest, but all the peripheral elements reflect what the complainants maintained".
