Partial unemployment classical or long-term : what has changed and what will change

In addition to the part-time unemployment classic, a system of partial unemployment of long duration is going to be put in place from 1 July. The point on the changes.

For the past three months, the device activity partial - commonly called "partial unemployment" or "technical unemployment"- has been amended multiple times and still be effective 1 October. At the same time is introduced a system of partial unemployment of long duration from the 1st of July.

Before the Covid-19

In the case of a reduction of activity, a company could operate a system of part-time workers, approved by the administration. The company asked a number of hours for six months. This plan, unified since 2013 (before coexisted a classic diet and a long time), was compensated to the tune of 7,74 euro per hour (7.23 rate of euros to the companies of at least 250 employees) with the company. The employee touched 70% of his gross salary (or 84% of net). Nothing prohibited the company offset the rest.

For the containment

To compensate for the abrupt cessation of activity and "avoid layoffs", the government, is a perfect match on what had been done in Germany during the crisis of 2008, has encouraged companies to use widely, and has increased to one year the time allowed. The employee touched, still 84% of his net salary, but the company was compensated at 100% of the compensation paid to the employee, up to 4.5 times the Smic (instead of at the level of the Minimum wage previously).

Several categories of employees (part-time employees, temporary employees, employees for the plan update, VRP, employees at home, apprentices, seasonal workers, etc), have built-in the device, enlargements greeted both by the employers as by the trade unions. Has also been introduced the possibility to individualize the partial unemployment within the same team, prohibited before.

at the same time, the device was used from may 1, to compensate employees unable to work because they were children and who, since the beginning of the containment, had been able to put off disease. In contrast, xed-term and interim short-term could not benefit from this safety net, nor the independents, who have, themselves, benefited from a fund.

According to estimates by the ministry of Labour, 7.2 million French were unemployed in part one or more days per week in march, to 8.7 million in April and $ 7.8 million in may. The State has budgeted $ 31 billion over the year to pay the bill.

After the containment

in order To "support the recovery", the government has reduced the wing since June 1st : companies are now compensated not 100% but to 85% by the State and Unédic, always within the limit of 4.5 times the Minimum wage, except for the sectors which are most affected, which are not affected by the decline and continue to be supported 100%. We find the hotel, catering, tourism, events, culture, air transport...

A new plan for the comeback

as of 1 October, the partial unemployment will be supported by the State to the tune of 72% of the net wage (60% of the gross) for the employee, with compensation at the rate of 60% for companies. It will be valid for three months, renewable three-month, six-month maximum. The unions were these last days wind standing to the idea of a decline in compensation of employees.

An alternative scheme : the reduced activity of continuance of employment

at the same time is established "of the reduced activity of the maintenance in employment", which shall enter into force as from the 1st of July. This part-time unemployment long-term has been recognised in principle by the project of the act health emergency. The company shall be confronted with a decrease of the activity up to 60% and can be used for a maximum duration of two years.

The goal : help companies "face a reduction in activity is sustainable, is not of a nature to compromise their sustainability", in return for commitments on employment. This device allows a working time reduction of up to 40%. Inspired by a text signed in the metal, it could be used in aeronautics, for example.

Condition : it must necessarily be the subject of an agreement of the majority class in the company or in the sector, and include "the commitments specifically entered into consideration, especially for the maintenance of employment".

The employee will receive 84% of his net salary. The company will be compensated at 85% of the compensation paid to the employee, (or 15% of the cost) for an agreement entered into before the 1st of October, and 80% for an agreement concluded after. Training costs may be supported at up to 80%. In a small business (less than 11 employees) in the absence of the union delegate, the agreement can go through pre-oendum, as provided in the ordinances work in September 2017.
