The new regulations do not affect vapers
The Council of Ministers approved this Tuesday to legally equate heated tobacco with traditional tobacco and to prohibit it from containing flavourings, while requiring that the labeling include warnings that it is harmful to health.
In this way, it has approved the Royal Decree that regulates certain aspects related to the manufacture, presentation and marketing of tobacco products and related products.
In addition, the prohibition on marketing tobacco products with a characteristic aroma or that contain flavorings in their components - such as filters, smoking papers, containers or capsules - or any other technique that allows modifying the smell, taste of tobacco products, as well as how to intensify the smoke of heated tobacco products. In addition, filters, papers and capsules may not contain tobacco or nicotine.
Likewise, the exception to the obligations to include an informative message and combined health warnings is withdrawn. Therefore, the packaging units and outer packaging of heated tobacco products must include the following information message: "Tobacco smoke contains more than 70 carcinogenic substances." In addition, they must include the color photographs specified in the image library of Annex II of Royal Decree 579/2017, of June 9.
The Government thus transposes the Delegated Directive, of June 9, which modifies Directive 2014/40/EU with regard to the withdrawal of certain exceptions applicable to heated tobacco products, in order to make it comparable to conventional cigarettes. This Royal decree will come into force within three months from its publication in the BOE.
In this way, the Government transposes European Directive 2022/2100, which modifies Directive 2014/40/EU of the European Parliament and of the Council with regard to the withdrawal of certain exceptions applicable to heated tobacco products.
This comparison affects only heated tobacco and not vapers. In this sense, the Minister of Health, Mónica García, has published a message on the social network of smoke and other aspects to prevent addictions and protect public health.
