This Sunday, the Investigative Court Number 44 of Madrid released without precautionary measures - including the restraining order requested by the victim - the lawyer and son of the president of the Constitutional Court (TC), Cándido Conde-Pumpido Varela, and two other men, brought to justice today by the State security forces, for an alleged crime of sexual assault, according to legal sources consulted by Europa Press.

The head of said court, María Isabel Durántez, has thus rejected the request of the Prosecutor's Office, which had requested a restraining order for an alleged crime of sexual assault, although she had not requested prison because the victim did not present injuries, according to tax sources.

In the order, to which this news agency has had access, the instructor points out that, "from what has been done so far, it is estimated that there is no objective situation of risk for the complainant that justifies the adoption of the precautionary measure concerned."

Conde-Pumpido Varela was arrested on Friday by the National Police after a girl reported an alleged group sexual assault, according to 'El Debate' and police sources have confirmed to Europa Press.

The woman reported that she was sexually assaulted by Conde-Pumpido Varela and the other two men when they were at the home of the son of the president of the TC, in Madrid. That same Friday night, members of the National Police came to arrest the three men.

The judge details in the order that the images from the home's security cameras provided by Conde-Pumpido Varela's defense "distort the version" of the alleged victim.

In the recording, where "different rooms" of the house are seen throughout the early hours of the morning and until the early hours of Friday morning, "no situation similar to the one described" by the woman in the complaint is observed, it says. .

The judge indicates that, although the complainant and Conde-Pumpido Varela are seen, another of the men indicated by her does not appear -- "who, according to his statements, can prove that he was located in another place since 10:00 p.m." on Thursday. -- "without being able to guess any situation that coincides with the woman's account of events."
